Terms of Use

Last updated: 2026-10-13

These Terms of Use are the agreement between you and lovingapp, Inc. ("loving", "we"), the operator of the loving AI commerce platform, and they govern your access to and use of the platform: the dashboard, the AI builder and other AI features, the storefronts loving hosts, the loving account you shop with, and every related service. Our registered details are in the Legal Notice. By creating an account or using the service you agree to these terms. If you use loving on behalf of a business, you confirm that you are authorized to bind that business.

The following policies are part of these terms and are incorporated by reference: the Privacy Policy, the Acceptable Use Policy, the Subscription & Billing Policy, the Refund & Purchase Policy, the Cookie Policy, the IP & DMCA Policy and — for merchants whose stores process personal data — the Data Processing Addendum.

The service

loving lets merchants create and run online stores: an AI agent designs and builds the storefront, and the platform provides catalog, orders, payments, shipping, inventory, content, localization, customer-service, marketing, finance, team and analytics tools. We continuously improve the service and may add, change or remove features. Some features depend on third-party providers (for example payment processing, shipping carriers and AI model providers) and are subject to those providers' availability.

The paid service is offered to businesses. If you sell through loving, you use it as a trader, not as a consumer.

Eligibility and your account

You must be at least 16 years old — and old enough to form a binding contract where you live — to create an account. Merchants sign in with a Google account or a one-time email code; shoppers sign in with a one-time email code. You are responsible for keeping access to your email account (and Google account) secure, and for everything that happens under your loving account.

You are responsible for the accuracy of the information you provide and for anyone you invite as staff. The permissions you grant staff members determine what your team can see and do; you are responsible for their actions in your store. Notify us promptly if you suspect unauthorized access to your account.

Subscriptions, credits and billing

Each store needs its own subscription, billed in advance through Stripe — monthly, or annually at a discount (currently US$60 a month or US$600 a year; the current prices are on the pricing page). Without a subscription you can still set up a store and design by hand, but the storefront is not published and some features are read-only.

The subscription includes an allocation of AI credits every calendar month, and additional credit packs can be bought while a subscription is active. Credits pay for AI image generation only. Every other AI feature — the store builder and dashboard assistant, Studio's AI, the writing assistant and "Enhance with AI", translation, marketing and customer insights, and the storefront shopping assistant — is included in the subscription and never uses credits. An image is generated only when your balance covers it, so the balance never goes below zero. Credits have no cash value, are not redeemable outside the platform, and are not refundable. The details are in the Subscription & Billing Policy.

If your subscription lapses, your storefront goes offline and dashboard features are limited until you reactivate. Cancelling stops renewal at the end of the current billing period; fees already paid are not refunded except as described in the Refund & Purchase Policy. Your data is retained as described in the Privacy Policy.

Your store and your duties as its seller

You are the seller. Each store is your business, not loving's. You are the trader your customers contract with, and the controller of their personal data. You are responsible for your products, their legality and safety, your prices and taxes, fulfilling orders, honoring the policies you publish, and complying with the laws of every market you sell into — including consumer-protection, product-safety, price-indication, export-control and data-protection laws.

Your legal details. Fill in your business's legal identity in the dashboard (Account → Business). loving gives every store editable privacy, terms, refund, shipping, legal-notice and right-of-withdrawal pages that use those details, the checkout states that an order is binding with payment and links your terms and withdrawal information, and order confirmations name you as the trader. These pages are templates, not legal advice: you are responsible for reviewing and completing them for your business and the markets you sell into.

Prices and reviews. Where the storefront shows a reduced price next to a struck-through one, the platform shows the lowest price of the previous 30 days, as EU law requires; do not set prices to get around that. Reviews show whether they come from a verified purchase. You must not publish, buy or invent fake reviews, or hide negative ones in a way that misleads.

Marketing to your customers. You decide whom you market to and you are responsible for having a lawful basis for it. Use the consent tools loving provides: double opt-in for marketing email (on by default), recorded opt-in for WhatsApp marketing, and the storefront's cookie question before analytics and advertising. If you choose to ask only visitors in the EEA, UK and Switzerland for consent, you are responsible for that choice being lawful everywhere else you sell.

Your use of the platform must comply with the Acceptable Use Policy. We may restrict content or accounts as described below and there.

AI features and AI-generated content

loving's AI features are powered by third-party model providers (Anthropic and OpenAI). The content you submit to an AI feature is processed as described in the Privacy Policy.

As between you and loving, you own the storefront code, copy and images the AI generates for your store, to the extent permitted by law. AI output can be inaccurate, incomplete or similar to output generated for others, and is provided without any warranty, including any warranty of non-infringement. You are responsible for reviewing AI output before publishing it — in particular product claims, prices, legal pages and translations.

Pictures of people. You must hold the rights, and any consent the law requires, for every photo of a person you upload or ask the AI to use — for example a model release from the people in your product photos. Do not use the AI to make images of a real, identifiable person without their permission. Where the law requires it — such as Article 50 of the EU AI Act for realistic images, video or audio of people generated or altered by AI — you must disclose that your content was generated or manipulated by AI. The storefront shopping assistant is labelled as AI to shoppers; do not present it as a person.

Payments and payouts

Customer payments are processed by Stripe, with loving acting as the payment platform. To take payments you connect a Stripe account for your store; Stripe's own terms apply to that account, and payouts are subject to Stripe's onboarding and compliance checks. Every payment is charged on behalf of your store, which is the merchant of record for its sales.

loving takes an application fee from each payment: its commission (a percentage of the order, shipping included) plus a pass-through of the estimated card-processing cost. The current rates are shown in your payments dashboard. Proceeds are paid out to your connected account on Stripe's payout schedule, which includes a short delay (currently seven days by default).

Your sales remain your commercial responsibility: refunds, disputes and chargebacks on your orders — including associated fees — are yours to resolve and fund. If a dispute is lost, the amount is recovered from your connected account.

Your content and license to us

You retain all rights to the content you or your AI agent add to your store — your brand, product data, images, pages and other materials. You grant loving a worldwide, non-exclusive license to host, store, reproduce, process, adapt (for example resizing images or compiling storefront code), publish and distribute that content solely to operate, secure and improve the service — including serving your public storefront to shoppers. You are responsible for having the rights to everything you upload or instruct the AI to use.

Customer data

Data about your store's customers belongs to your business, and you are its controller. loving processes it on your behalf to operate the store — as described in the Privacy Policy and the Data Processing Addendum. You agree to handle customer data lawfully and to keep accurate, honest store policies for your customers.

If you are a shopper

When you buy from a store hosted by loving, your contract of sale is with that store's merchant, not with loving: the merchant is responsible for the products, delivery, returns, refunds and your statutory rights, including any right to withdraw from the purchase. Each store's own terms, refund and withdrawal pages explain them.

Your loving account lets you sign in to every loving store. You can delete it at any time from your account center, as described in the Privacy Policy. Nothing in these terms limits the rights you have as a consumer under the law where you live.

Reporting content, our decisions and appeals

Reporting. Anyone can report content or a store they believe is illegal or breaks our policies using the form at /legal/report or by email to hello@loving-app.com. A report should explain why the content is illegal or against our policies, give its exact address, and include your name and email address (except for reports of child sexual abuse material, which can be made anonymously). We confirm receipt, review reports diligently and objectively, and tell you what we decided.

Our decisions. When we remove or restrict content, take a store offline, or suspend a feature or an account because content is illegal or breaks these terms, we tell the affected merchant or user why — the facts, the rule or law relied on, whether automated means were used, and how to challenge the decision — unless the law prevents it or the content is deceptive high-volume commercial content.

Appeals. You can ask us to review a decision about your content or account, or our decision on a report you made, within six months, by replying to our decision or writing to hello@loving-app.com. A person who was not involved in the original decision reviews it, and we reverse it if it was wrong. If you are in the EU, you may also use a certified out-of-court dispute settlement body, or go to court.

Misuse. We may suspend, for a reasonable period and after a warning, the accounts of people who frequently post manifestly illegal content, and stop processing reports from people who frequently submit manifestly unfounded ones.

Intellectual property

loving and its software, design systems, documentation and brand remain our property. You receive a limited, non-exclusive, non-transferable right to use the platform while your subscription is active. You may not copy, modify, resell or reverse-engineer the platform except where the law permits. Feedback you send us may be used without obligation to you.

Copyright and trademark complaints are handled under the IP & DMCA Policy.

Termination and store deletion

You can cancel your subscription or delete your store at any time. Store deletion starts a 30-day recovery window during which the store is offline but restorable; after the window the store and its data are permanently deleted, except for records we must retain for tax, accounting or legal reasons (for example invoices and payment ledger entries). An account that still owns a live store cannot be deleted until the store is deleted or transferred.

We may suspend or terminate accounts that violate these terms or create risk for the platform, other users or third parties. We give notice and our reasons where practicable and as described in "Reporting content, our decisions and appeals". Sections that by their nature should survive termination — including payment obligations, disclaimers, limitations of liability and indemnity — survive.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free or secure, or that AI output will be accurate or suitable for your purposes.

Limitation of liability

To the maximum extent permitted by law, loving is not liable for lost profits, lost revenue, lost data, or indirect, incidental, special, consequential or punitive damages arising from your use of the service. Our total liability for any claim arising out of these terms or the service is limited to the amounts you paid loving in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

If you are a merchant, you will defend and indemnify loving against claims, damages and expenses (including reasonable legal fees) arising from your store, the products you sell, the content you publish, your use of the service in violation of these terms, or your violation of law or third-party rights.

Changes to these terms

We may update these terms as the product evolves. We announce material changes in the dashboard before they take effect and ask merchants to accept the updated terms there; the "Last updated" date above changes with every revision. If you do not accept a change, you can cancel before it takes effect.

Governing law and disputes

If you use loving for your business, these terms and any dispute arising from them or from the service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the parties submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

If you are a consumer — for example a shopper with a loving account — that choice of law does not take away the protection of the mandatory rules of the law of the country where you habitually live (in the EU, Article 6 of the Rome I Regulation). You may bring proceedings against us in the courts of the place where you live, and we may bring proceedings against you only in those courts (in the EU, Article 18 of the Brussels I bis Regulation). The same applies wherever the law where you live gives consumers equivalent protection, including in the United Kingdom.
